Pyramidal Idol Altar implicit counting same hight as above for vertical idols

Background
The pyramidal Altar Idol Altar has a implicit condition requiring that there are “no larger idols above smaller ones in the grid”

This is further clarified as: "“An idol is considered larger than another if it takes up more squares of the grid. An idol is considered above another idol in the grid if its top left corner is closer to the top of the inventory.”

Issue
When placing a smaller vertical idol next to a larger horizontal one, the implicit of the idol altar wont activate despite the top left corner being the same distance from the top.
This seems to occur whenever the smaller idol extends below the larger idol.
