I used the Chronomancer in the End of Time and tried refunding points on my Lich. I refunded 3 points from Corrosive Consciousness but did not get the points back. I would be willing to test further on another character since she is lvl 90 and would have a hard time recovering points if re-leveling was required.
Is it an old character dating back to before the rework of the first few chapters of the game back in 0.7.10 back in Oct 20? They removed 4 passive points as quest rewards.
